These Terms of Service (“Terms”) form an agreement between you and Kovion LTD (“Kovion”, “we”, “us” or “our”) governing your access to Kovify Player, its website, applications, streaming features, audio tools, and related services (together, the “Service”). By creating an account or using the Service, you agree to these Terms.
1. Eligibility and accounts
You must be legally capable of entering this agreement. If you are under the age at which you may enter a binding contract where you live, a parent or legal guardian must review and accept these Terms for you. You are responsible for accurate account information, keeping credentials secure, and all activity performed through your account.

2. The Service
Kovify provides private music-library management, audio playback, playlists, listening history, equalisation and audio processing, and adaptive radio generated from your listening activity. Features may change as the Service develops. We may introduce, change, suspend, or retire features where reasonably necessary for security, legal compliance, performance, or product development.
3. Your music and content
You retain ownership of content you upload. You grant us a limited, non-exclusive licence to host, copy, transcode, process, and stream that content only as needed to operate and secure the Service for you.
You confirm that:
- you own the content or have all permissions and licences needed to upload, store, process, and play it;
- your content and use of the Service do not infringe copyright, privacy, publicity, contractual, or other rights;
- you will not use Kovify to distribute unlawful copies or provide unauthorised public access to protected recordings; and
- metadata, artwork, and other information you provide is lawful and not deceptive.
4. Acceptable use
You must not:
- break the law, infringe another person’s rights, or encourage either;
- bypass access controls, probe for vulnerabilities without written permission, or interfere with the Service or another user;
- introduce malware, automate abusive requests, scrape private data, or overload infrastructure;
- reverse engineer protected parts of the Service except where the law expressly permits it;
- impersonate another person, misrepresent affiliation, or use the Service for fraud; or
- resell or commercially exploit the Service unless we have agreed in writing.
5. Copyright complaints
We respect intellectual property rights and may remove or restrict access to material reasonably believed to infringe them. Rights holders can submit a notice to [email protected]. Our full notice and counter-notice process is set out on the Copyright & DMCA page.
6. Personalisation and listening data
Adaptive radio uses signals such as listening time, repeat plays, recent plays, likes, artists, and genres to rank tracks from your library. This personalisation is designed for music discovery; it does not make decisions that produce legal or similarly significant effects. You can clear listening history through the Service.
7. Service availability and changes
We aim to provide a reliable Service, but uninterrupted or error-free operation cannot be guaranteed. Maintenance, network conditions, third-party services, security events, and circumstances outside our reasonable control may affect availability. Keep independent backups of music and information that matters to you.
8. Suspension and termination
You may stop using the Service at any time. We may restrict or suspend access where reasonably necessary to investigate abuse, protect users or infrastructure, comply with law, or respond to a serious or repeated breach. Where appropriate, we will give notice and a reasonable opportunity to address the issue.
9. Disclaimers
The Service is provided with reasonable care and skill. Except for rights and warranties that cannot lawfully be excluded, the Service is provided “as available” and we do not promise that every feature will be available at all times or compatible with every file, device, or environment.
10. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation. Subject to that, we are not responsible for losses that were not reasonably foreseeable, losses caused by your breach, or business losses arising from consumer use. Any mandatory consumer rights remain unaffected.
11. Governing law
These Terms are governed by the laws of England and Wales. Courts in England and Wales have jurisdiction, except that consumers may also have rights to bring proceedings in the part of the United Kingdom or country where they live.
12. Changes to these Terms
We may update these Terms to reflect legal, security, or Service changes. We will update the date above and provide reasonable notice of material changes. Continuing to use the Service after an update takes effect means the revised Terms apply.
